Minnesota Bureau of Criminal Apprehension Orders Statewide Inspection of DWI Testing Instruments
After discovering data entry errors in certain DWI testing instruments, the Minnesota Bureau of Criminal Apprehension (BCA) has instructed law enforcement agencies across the state to inspect their devices immediately. The errors were found in two DataMaster DMT instruments, which measure breath alcohol levels, and are related to gas cylinder installation on the devices.
The BCA found that the two devices with errors were located in Olmsted County and Hennepin County, potentially affecting 108 and 38 cases, respectively. Additionally, the BCA had previously discovered errors in Aitkin, Winona, and Chippewa counties. The BCA is requiring local law enforcement agencies to review and verify the dry gas cylinder data entered into the DataMaster instruments to ensure accuracy.
Immediate Action Required
The BCA has ordered the suspension of all DMT usage until agencies verify the gas cylinder data in each instrument. Furthermore, all gas cylinder replacements and maintenance will be performed by BCA personnel starting immediately. The BCA also plans to update its DMT maintenance procedures to prevent similar errors in the future. According to the BCA, the agencies using the DWI testing instruments are not necessarily responsible for the error, as multiple law enforcement agencies use each instrument.

We appreciate our law enforcement partners’ prompt attention to this inspection process.” Law enforcement personnel who administer the breath tests and maintain the DMT instrument are specially trained in their use by the BCA, highlighting the importance of accurate and reliable testing instruments.
