President Trump’s recent announcement of a $100,000 fee for certain skilled foreign workers has sent shockwaves through the tech industry, with many companies expressing concerns about the potential impact on their bottom line. The H-1B visa program, which allows companies to hire foreign workers in specialized fields such as technology and engineering, is a crucial component of the tech industry’s talent acquisition strategy.

The new fee, which will apply to new visa petitions submitted after September 21, has sparked confusion among businesses, immigration lawyers, and current H-1B visa holders. While the Trump administration has clarified that the fee will not be annual and will not prevent current visa holders from traveling in and out of the country, many questions remain about how the fee will be implemented and who will be exempt.

Impact on Tech Industry

The tech industry relies heavily on the H-1B visa program to attract top talent from around the world. Companies such as Meta, Apple, Google, Amazon, and Microsoft have all used the program to hire skilled workers, and many have expressed concerns about the potential impact of the new fee on their ability to compete in the global market. According to data from the U.S. Citizenship and Immigration Services, over 7,500 companies in California have applied for H-1B visas this fiscal year, with 61,841 approvals.

Experts warn that the new fee could slow California’s development and the United States’ position in the AI race by making it tougher for companies, especially startups with less money, to bring in international employees. “The U.S. isn’t producing enough workers with the skills needed,” said Darrell West, a senior fellow in the Center for Technology Innovation at the Brookings Institution. “Companies in technology, agriculture, hotels, restaurants, and construction rely heavily on immigrants, and slowing that flow is going to be devastating for companies in those areas.”

Reaction from Tech Executives

Tech executives, including Elon Musk, have been vocal about their support for the H-1B visa program. Musk, who was born in South Africa and held an H-1B visa before becoming a naturalized U.S. citizen, has publicly sparred with Trump over immigration policies. Other tech executives, including those from Meta, Amazon, Google, and Apple, have also spoken out about the importance of the H-1B visa program for their companies’ success.

However, the Trump administration has argued that the new fee is necessary to prevent companies from misusing the program and to prioritize American workers. “President Trump promised to put American workers first, and this commonsense action does just that by discouraging companies from spamming the system and driving down American wages,” said Taylor Rogers, a White House spokesperson.

Global Implications

The new H-1B visa fee could also have global implications, particularly for countries such as India, which sends a large number of skilled tech workers to the U.S. Indian nationals account for 71% of approved H-1B visa petitions, followed by those from China at approximately 12%. Some Indian venture capitalists and research institutes see the uncertainty surrounding H-1B visa rules as an opportunity to encourage talented engineers to return home and build startups, potentially fueling India’s tech sector.

Global tech companies may also consider opening more centers abroad where workers can work remotely and not have to move to the U.S. “The more the U.S. makes itself a less attractive place to bring in talent, the more it is going to harm its economy,” said Phil Fersht, the founder and chief executive of HFS Research.
