According to three people familiar with the matter, the bureau initially reassigned the agents last spring but has since terminated their employment. The exact number of FBI employees fired is not immediately clear, but it is reported to be roughly 20.

The photographs in question showed a group of agents taking the knee during one of the demonstrations after Floyd’s death, which sparked widespread anger and led to a national reckoning over policing and racial injustice. While the kneeling was seen as a possible deescalation tactic during a period of protests, it also angered some within the FBI. The incident highlights the complexities and challenges faced by law enforcement agencies in navigating issues of racial justice and social unrest.

Reaction from the FBI Agents Association

The FBI Agents Association has condemned the move, confirming that more than a dozen agents had been fired, including military veterans with additional statutory protections. The association has called on Congress to investigate, stating that the firings were unlawful and another indication of FBI Director Kash Patel’s disregard for the legal rights of bureau employees. The association’s statement emphasized that “nobody is above the law,” but rather than providing fair treatment and due process, Patel chose to violate the law by ignoring the agents’ constitutional and legal rights.

The firings come amid a broader personnel purge at the bureau, as Patel works to reshape the nation’s premier federal law enforcement agency. Five agents and top-level executives were known to have been summarily fired last month, contributing to declining morale among current and former officials. The ousted agents include those who worked on high-profile investigations, such as the Jan. 6, 2021, riot at the U.S. Capitol and the investigation into President Trump’s hoarding of classified documents.

Concerns Over Politicization and Retaliation

A lawsuit filed by some of the fired FBI agents alleged that Patel communicated that he understood it was “likely illegal” to fire agents based on cases they worked on, but was powerless to stop it due to pressure from the White House and the Justice Department. Patel has denied taking orders from the White House on whom to fire, stating that anyone who has been fired failed to meet the FBI’s standards. The incident raises concerns over the politicization of the FBI and the potential for retaliation against agents who work on sensitive or high-profile cases.
