Former California Legislature Staff Member Sues Assembly Speaker Robert Rivas
A recently fired California Legislature staff member, Cynthia Moreno, has filed a lawsuit against Assembly Speaker Robert Rivas, alleging retaliation for reporting sexual harassment and ethics violations. Moreno, who worked as a press secretary, claims that the speaker and his brother, Rick, targeted her after she filed a complaint against a colleague in May 2024.
According to the lawsuit, filed in Sacramento County Superior Court, Moreno was stripped of significant job responsibilities after reporting the alleged harassment. She also filed a complaint with the Workplace Conduct Unit, which investigates allegations of inappropriate conduct by legislative employees, alleging that Rick Rivas and others had funneled money to exert influence on the speaker.
Allegations of Retaliation and Ethics Violations
Moreno alleges that Rick Rivas used his influence to deny her a tenure-based pay raise and terminate her employment in response to her complaints. Rick Rivas, who serves as vice president for the American Beverage Association and has acted as a political advisor to his brother, did not immediately respond to requests for comment.
Elizabeth Ashford, a spokesperson for Robert Rivas, denied the allegations, stating that the speaker’s brother had no role in Moreno’s employment and that the lawmaker had recused himself from all matters related to her termination. Ashford described the lawsuit as “an attempt by a former employee to force a payout” and said that the allegations were “absolutely false.”
Investigation and Termination
The Assembly Rules Committee terminated Moreno in August after an investigation substantiated allegations of sexual harassment that had been lodged against her. However, Moreno has denied these allegations, which she claims were “made-up” in retaliation for reporting the alleged misconduct by the Rivas brothers.
Moreno is seeking damages for lost wages and benefits, lost business opportunities, and harm to her professional reputation. She is also seeking a public apology for the alleged retaliation and harassment. The lawsuit highlights the importance of protecting employees who report misconduct and ensuring that those in positions of power are held accountable for their actions.
